SOUL SURF CLUB TERMS & CONDITIONS

SOUL SURF CLUB TERMS & CONDITIONS

These Terms & Conditions apply to all participants, parents, guardians, visitors, members, customers and guests attending or participating in any lesson, programme, membership, camp, event, competition, trip, activity or service provided by Soul Surf Water Sports Training LLC ("Soul Surf Club").

By booking, registering, attending, participating or making payment, you acknowledge that you have read, understood and agreed to these Terms & Conditions in full.

Governing Law: Dubai, United Arab Emirates

Any dispute arising from participation, membership, bookings, purchases or services shall be governed by the laws of Dubai and the United Arab Emirates and shall be subject to the exclusive jurisdiction of the courts of Dubai.


ACCEPTANCE OF RISK

Surfing, ocean activities, water sports, fitness training and related activities involve inherent risks.

Participants and parents/guardians acknowledge and accept these risks and voluntarily participate at their own risk.

All participants agree to follow the instructions of Soul Surf Club coaches, staff and representatives at all times.

Soul Surf Club reserves the right to refuse, suspend or terminate participation where instructions are not followed or where behaviour compromises safety.

All safety decisions are final.


MEDICAL INSURANCE

All participants must hold valid medical insurance providing coverage within the United Arab Emirates.

This requirement applies to UAE residents, visitors and tourists.

It is the responsibility of the participant, parent or guardian to ensure adequate insurance coverage is maintained throughout participation.

Soul Surf Club reserves the right to request proof of valid insurance coverage at any time before or during participation.

Failure to provide satisfactory evidence of insurance may result in participation being refused, suspended or terminated without refund, credit or compensation.

Soul Surf Club accepts no responsibility for medical costs, treatment costs, insurance claims or expenses arising from participation.


MEDICAL DISCLOSURE

Participants and parents/guardians must disclose all relevant medical information prior to participation.

This includes but is not limited to:

• Medical conditions

• Injuries

• Allergies

• Disabilities

• Medication requirements

• Physical limitations

Failure to disclose relevant information may result in removal from activities without refund.

Soul Surf Club accepts no liability arising from undisclosed medical conditions or circumstances.


BOOKINGS, PARTICIPANT NUMBERS & PAYMENT

All bookings, memberships, camps, lessons, programmes, registrations and activities must be paid for in advance unless otherwise agreed in writing by Soul Surf Club.

Participant numbers must be declared accurately at the time of booking.

Any participant not included within the original booking may be refused participation.

Where additional participants arrive without prior approval, Soul Surf Club reserves the right to:

• Refuse participation.

• Require immediate payment before participation.

• Modify the session structure.

• Terminate the activity.

• Cancel the session entirely.

If a session cannot be safely delivered due to inaccurate booking information, undeclared participants, non-payment, participant behaviour or circumstances created by the customer, Soul Surf Club reserves the right to refuse or terminate the session without refund, credit or compensation.

All decisions relating to participant numbers, coach-to-participant ratios, equipment allocation, participant suitability and safety remain solely at the discretion of Soul Surf Club.

These decisions are final.


MEMBERSHIPS, PACKAGES & SURF CREDITS

All memberships, registrations, credits, packages and prepaid services are non-refundable.

Memberships, registrations and surf credits:

• Hold no cash value.

• Are non-transferable.

• Cannot be exchanged for cash or alternative services.

Unused credits may only be carried forward at the sole discretion of Soul Surf Club.

Soul Surf Club reserves the right to amend package structures, membership benefits, pricing and credit systems at any time.


CANCELLATIONS, ABSENCES & REFUNDS

Soul Surf Club operates a strict no-refund policy.

Once payment has been made, all bookings, memberships, registrations, camps, events, packages and activities are considered final.

Requests to reschedule may be considered with a minimum of 48 hours notice and remain entirely at the discretion of Soul Surf Club.

Failure to attend a booked session will normally be treated as a used session.

Refunds, credits, extensions or compensation will not be provided unless expressly agreed in writing by Soul Surf Club.


SURF CONDITIONS, WEATHER & SERVICE DELIVERY

Surfing is an outdoor ocean-based activity.

Wave conditions, weather conditions and environmental factors cannot be guaranteed.

By participating, customers acknowledge that wave size, wave quality, weather conditions, tides, wind, currents, water conditions, beach conditions and other environmental factors are entirely outside the control of Soul Surf Club.

The absence of waves, poor surf conditions, changing conditions, participant expectations, weather conditions or environmental conditions shall not constitute grounds for cancellation, refund, credit, compensation or dispute.

Soul Surf Club reserves the right to:

• Change locations.

• Modify session times.

• Alter group structures.

• Adjust coaching ratios.

• Postpone activities.

• Cancel activities.

• Substitute activities.


Where surf conditions are unsuitable, Soul Surf Club may substitute activities with alternative surfer development programmes including:

• DrySurf Training

• Water Confidence Training

• Paddle Training

• Mobility & Fitness Training

• Ocean Education

• Surf Theory

• Video Analysis

• Competition Preparation

• Other progression-based activities


Participation in alternative activities shall be deemed full delivery of the booked service.

No refunds, credits, extensions or compensation shall be provided as a result of weather, surf conditions, environmental factors or circumstances beyond the reasonable control of Soul Surf Club.


Soul Surf Club does not guarantee wave quality, wave size, weather conditions, surf conditions, session frequency, participant progression, coaching outcomes, skill development outcomes, competition results or the availability of specific coaches.


COACHING AUTHORITY & SAFETY DECISIONS

The Head Coach and authorised Soul Surf Club representatives retain absolute authority over all coaching, operational and safety decisions.


This includes but is not limited to:

• Session structure

• Equipment allocation

• Group composition

• Participant suitability

• Coaching methods

• Session locations

• Session delivery

• Safety procedures

All decisions made by Soul Surf Club staff and coaches are final.

Failure to follow instructions may result in immediate removal from the activity without refund, credit or compensation.


PARENT & SPECTATOR CONDUCT

Parents, guardians and spectators must not:

• Interfere with coaching.

• Enter designated coaching areas without permission.

• Enter the water during sessions unless specifically authorised.

• Provide conflicting coaching instructions.

• Challenge safety decisions during activities.

• Disrupt the delivery of sessions.

• Behave aggressively, abusively or unreasonably towards staff, volunteers, coaches, participants or other families.

Soul Surf Club reserves the right to terminate participation or membership where such behaviour occurs.


CHILD COLLECTION & SUPERVISION

Soul Surf Club is responsible for participants only during advertised session times.

Parents and guardians remain responsible for participants:

• Prior to session commencement.

• Immediately following session completion.

• During any period where participants are not actively under the supervision of Soul Surf Club staff.

Soul Surf Club accepts no responsibility for children outside designated coaching times.


EQUIPMENT USE & DAMAGE

All equipment supplied by Soul Surf Club remains the property of Soul Surf Club unless otherwise agreed in writing.

Participants are expected to use equipment responsibly and in accordance with coach instructions.

Soul Surf Club reserves the right to recover costs associated with equipment damage resulting from:

• Deliberate misuse.

• Reckless behaviour.

• Negligence.

• Failure to follow instructions.

Normal wear and tear is excluded.


PERSONAL PROPERTY

Soul Surf Club may provide a beach tent, gazebo, meeting point, storage area or designated gathering area for the convenience, welfare and safety of participants.

All personal belongings remain entirely the responsibility of the owner at all times.

Soul Surf Club accepts no responsibility or liability whatsoever for the loss, theft, damage, deterioration or misplacement of personal belongings.

Participants are strongly advised not to leave valuables unattended.

Any lost property recovered by Soul Surf Club may be retained for a maximum period of seven (7) days.

Items not collected within this period may be donated, disposed of or otherwise removed without notice.

Soul Surf Club accepts no responsibility for items not collected.


SPECIAL EVENTS, TRIPS & THIRD-PARTY FACILITIES

For wave pool sessions, camps, competitions, trips, travel activities or activities operated in conjunction with third-party facilities, Soul Surf Club may require additional documentation including insurance verification, identification, waivers, emergency contact information or medical declarations.

Failure to provide requested documentation may result in refusal of participation without refund.


CONDUCT, MEMBERSHIP & CLUB VALUES

Soul Surf Club reserves the right to refuse, suspend or terminate participation or membership at any time.

This includes but is not limited to:

• Aggressive behaviour.

• Abusive behaviour.

• Threatening behaviour.

• Harassment.

• Intimidation.

• Unsafe behaviour.

• Disruptive behaviour.

• Failure to follow instructions.

• Conduct that negatively impacts the safety, operation, culture, values or reputation of the club.

Membership may be refused, suspended or terminated where the conduct of a participant, parent, guardian or associated family member is considered detrimental to the club.

Where participation or membership is terminated for behavioural, cultural or conduct-related reasons, no refund, credit or compensation shall be provided.

Soul Surf Club reserves the absolute right to determine whether conduct is inconsistent with the values, culture, objectives or reputation of the club.


ANTI-BULLYING & INCLUSION

All participants, parents, guardians, coaches and volunteers must comply with the Soul Surf Club Anti-Bullying, Inclusion & Community Policy.

Any behaviour that excludes, intimidates, harasses, isolates, undermines or negatively impacts another member of the Soul Surf community may result in suspension or termination of membership.


PHOTOGRAPHY & MEDIA

By participating in Soul Surf Club activities, participants and parents/guardians grant permission for photographs, videos and media captured during activities to be used for coaching, educational, marketing, promotional and social media purposes.

Requests for removal of specific content may be considered but cannot be guaranteed.


PAYMENT DISPUTES & CHARGEBACKS

By completing payment, the customer acknowledges that Soul Surf Club immediately incurs operational costs including staffing, coaching allocation, administration, equipment allocation and resource planning.

Customers agree not to initiate chargebacks, payment disputes or payment reversals for services attended, delivered, reserved or otherwise made available in accordance with the booking.

Soul Surf Club reserves the right to recover any costs incurred in responding to payment disputes, chargebacks or collection actions arising from false, misleading or unreasonable claims.


LIMITATION OF LIABILITY

To the fullest extent permitted by law, Soul Surf Club, its directors, employees, coaches, volunteers, contractors and representatives shall not be liable for any direct, indirect, incidental, consequential or special loss, damage, injury, expense or claim arising from participation in any activity, lesson, camp, event, programme, membership or service.

Participation is undertaken entirely at the participant's own risk.


WEBSITE USE

Users under the age of 18 may not register or make purchases directly through the website.

All bookings for minors must be completed by a parent or legal guardian.

Users agree not to use the website for unlawful, abusive, fraudulent or harmful purposes.

Soul Surf Club reserves the right to refuse service, restrict access or terminate accounts at its sole discretion.


CHANGES TO TERMS & CONDITIONS

Soul Surf Club reserves the right to amend, modify or update these Terms & Conditions at any time without prior notice.

Continued participation, booking or use of services shall constitute acceptance of any revised Terms & Conditions.


FINAL DECLARATION

By completing a booking, registration, membership purchase or participation in any Soul Surf Club activity, the participant and/or parent or guardian confirms that they have read, understood and agreed to:

• The Soul Surf Club Code of Conduct

• The Soul Surf Club Anti-Bullying, Inclusion & Community Policy
